The legal system works well if you stay out of court. Court cases often take years and are very costly with no predictability for results. Justice does not always triumph.  If you settle a dispute you avoid the expense, delay and the risk.  It is worth giving up something in order to arrive at a settlement that you can live with.  When you give up something usually you get something in return and all parties to a dispute are able to get on with business or living their lives.  The mediation process is an ideal way to work out a settlement outside of court.  If mediation fails there is the option of arbitration where a privately chosen “decider” will make a decision that is binding on the parties.  The parties can select an arbitrator that they believe is best qualified to make a decision. It can be a person with a technical or business background in the area of the dispute rather than a judge who just happens to be assigned the case.  Also arbitration is usually cheaper, faster and more private than court.
